Legal guarantee of conformity for goods, the existence and conditions of after-sales services, and commercial guarantees

Warranty Application

The warranty applies:

• When the product is not suitable for its intended use.

• When it performs differently than advertised.

• When it has a defect that renders it unusable.

• When the failure is caused by misuse resulting from incorrect instructions in the manual or from technicians sent by the seller.

To claim under the warranty, the consumer must present the invoice, receipt, or proof of purchase for the purchased product.

Product Conformity

Products will be considered to conform to the contract provided they meet the following requirements:

• They correspond to the description provided by the seller and possess the qualities of the product that the seller presented to the consumer in the form of a sample or model.

• They are fit for the purposes for which products of the same type are ordinarily used.

• They are fit for any special purpose required by the consumer, provided that the consumer has informed the seller of this purpose at the time of entering into the contract and the seller has acknowledged that the product is suitable for that purpose.

• They possess the quality and performance that are normal for products of the same type and that the consumer can reasonably expect, taking into account the nature of the product and, where applicable, any public statements made by the seller, the producer, or their representative regarding the specific characteristics of the products, particularly in advertising or labeling. The seller will not be bound by such public statements if they demonstrate that they were unaware of the statement in question and could not reasonably have been expected to know of it, that the statement had been corrected at the time the contract was concluded, or that the statement could not have influenced the decision to purchase the product.

Warranty Periods

a) New Products

New: The law stipulates that the seller is liable for any defects a product may have during the two years following the delivery date.

b) Defects Detected in the First 6 Months

If the product defect appears during the first six months, it is understood that the defect existed before the sale, and the product must be repaired free of charge or replaced. If the seller disagrees or believes the defect resulted from misuse, they must prove it.

If the defect appears after the first six months and the seller, upon receiving the product, considers that the defect is not due to a manufacturing error, the burden of proof shifts to the consumer. If the defect is proven to be original, the consumer is entitled to the warranty.

The one- and two-year warranty periods will be suspended while the repair is being carried out, and will begin again upon the return of the repaired product to the consumer. Such repairs will have a minimum warranty of six months.

Consumer Rights

Options with the Seller

If the item under warranty does not meet the optimal conditions for use, the consumer is entitled to one of the following options:

a) Free repair of the product. In this case, the seller must pay for labor, travel, parts, and shipping.

b) Replacement of the purchased item with another of identical characteristics. This option is not available for goods that cannot be replaced by identical ones (for example, a work of art) or for second-hand goods.

c) Price reduction. When product repair has not been possible or when repair has been carried out but the problem persists.

d) Termination of the contract by returning the product and requesting a refund, unless the defect is minor.

In cases of product repair or replacement, the seller must provide the consumer with a receipt stating the delivery date and the product defect. Similarly, once the product is repaired or replaced, the consumer will receive a document stating the delivery or repair date, as applicable.

Action against the producer

When it is impossible or excessively burdensome for the consumer to take action against the seller for a lack of conformity of the products with the contract, they may claim directly from the producer to obtain a replacement or repair of the product.

Generally, the producer will be liable for a lack of conformity when it relates to the origin, identity, or suitability of the products, in accordance with their nature and purpose and the regulations governing them.

The producer's liability will cease under the same terms and conditions as those established for the seller.

The party responsible to the consumer will have one year to seek reimbursement from the party responsible for the lack of conformity. This period begins from the moment the remedy was completed.

The Commercial Guarantee

This is a guarantee that the seller or manufacturer may voluntarily offer for a product and is in addition to the legal guarantee.

The commercial guarantee must be formalized, at least in Spanish, and, at the consumer's request, in writing or on any other durable medium directly available to the consumer, accessible to them, and compatible with the communication technology used.

The guarantee must necessarily state:

• The good or service covered by the guarantee.

• The name and address of the guarantor.

• That the guarantee does not affect the consumer's legal rights in the event of a lack of conformity of the products with the contract.

• The rights, in addition to the legal rights, granted to the consumer and user as the warranty holder.

• The duration of the warranty and its territorial scope.

• The complaint procedures available to the consumer and user.

The right to claim compliance with the provisions of the additional commercial warranty will expire six months after the warranty period ends.

Repair and After-Sales Services

For durable goods, consumers and users have the right to adequate technical service and the availability of spare parts for a minimum of five years from the date the product ceases to be manufactured.

It is prohibited to increase the price of spare parts when using them in repairs and to charge for labor, travel, or service calls amounts exceeding the average costs estimated in each sector. The invoice must itemize the different charges separately.

The price list for spare parts must be available to the public.

The right to claim a refund or return of products delivered by the consumer and user to the business for repair expires three years from the date of delivery.
